Meaningless Law in New York Concerning Health Club AEDs

NYS gyms have no duty to use defibrillators – The New York Court of Appeals recently held health clubs are not required to use automated external defibrillators, despite a state law requiring them to keep an AED on the premises and have someone trained in its use present during business hours. Then why have the legal requirement to keep the device on premises? And why is there a law on the books that requires the presence of a trained user? Seems like the Court of Appeals’ decision has rendered this New York statute meaningless.
