Missouri Court Wisely Rejects Damages Caps

This week, the Missouri Supreme Court struck down the state’s 2005 law limiting non-economic damages in medical malpractice cases to $350,000.  The Court stood up for consumers and plaintiffs, holding that “the right to trial by jury…is not subject to legislative limits on damages.”  The Missouri Constitution’s Bill of Rights states “that the right of a trial by jury as heretofore enjoyed shall remain inviolate.”
