Work Site – Missing Machine Safety Guard Injury

A typical Work Site personal injury case involves a Missing Machine Safety Guard. The safety guard, for a variety of reasons, was removed prior to the victim’s injury; and the resulting injury was caused by, or a result of, the guard’s removal. Inspection of the machinery, if at all possible, is critical to success. The entire work site, as soon as possible, should be inspected, looking at the total picture of the victim, the machine and the work environment. For example, when inspecting a large piece of machinery, an engineer cannot focus on just the machine. Other important and relevent aspects of the case are eye witness reports, incident and accident reports and the machine manuals. Also, a full investigation will include a look at the lighting conditions and sound levels; this might show that the machine operator was not aware that the machine was still operating when they reached into the machine to remove a workpiece. The crux of the case, of course, may simply be identifying who removed the machine safety guard prior to the accident. This comprehensive approach could be the difference between winning and losing your case.
