Drunk driver injury and death civil cases sometimes can fix blame against a bar, tavern or restaurant, and not only the drunken driver. In New York, this area of civil litigation law is often called the Dram Shop Act. Motor vehicle crashes caused by a drunken driver will most certainly include payments on behalf of the person who was driving while intoxicated. The additional source of compensation results from also suing the bar, tavern or restaurant where the drunk driver had been served alcoholic beverages just prior to getting behind the wheel and causing the crash. The theory is that the restaurant establishment had continued to serve the drunk driver beyond the point of intoxication.
