Fire cases, always interesting, differ on issues of liability and damages. For example, smoke inhalation personal injury vs. fire wrongful death. Residential cases, whether private homes or multiple dwellings, are the most common. Every case, of course, is different. Expert fire investigators need to be retained to investigate the fire and determine the origin and cause. Based on those findings, the case litigation strategy is determined. For example, negligent electrical work performed by electrical contractors during construction or renovation could establish a viable cause of action. Legal research will look at applicable laws and codes, such as the National Electrical Code, the National Fuel Gas Code, and the International Residential Building Codes. Depending upon the case specifics, fire experts can be supplemented by experts in mechanical and electrical engineering, to determine whether, beyond applicable fire codes, there was reasonably safe compliance with all applicable building code requirements and applicable standards of care.
